Moku — Terms of Service

1. About these terms
These Terms of Service ("Terms") are a legal agreement between you and Moku ("Moku", "we", "us", or "our"), the operator of the Moku mobile application (the "App") and any related services (together, the "Service").
Moku is operated from New South Wales, Australia. Our contact email is support@trymoku.ai.
By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
These Terms reference and incorporate our Privacy Policy.
2. Eligibility
You must be at least 17 years old to use Moku. By using the App, you confirm that you meet this age requirement.
You must have the legal capacity to enter into a binding agreement in your country of residence.
The App is distributed via the Apple App Store and is intended for personal, non-commercial use.
3. Your account
Anonymous use
You can use the App for your first five (5) food scans per day without an account. Anonymous usage is governed by these Terms.
Signed-in account
To continue scanning beyond the daily limit or to enable cloud sync, you must sign in with Sign in with Apple. We do not offer email/password sign-up.
You are responsible for safeguarding your Apple ID credentials. We are not liable for losses arising from unauthorised access caused by your failure to do so.
Account deletion
You may delete your account at any time from within the App: Profile → Delete account. This permanently deletes your profile, scan history, and any active subscription record on our servers. Instructions are also available at trymoku.ai/delete-account.
4. Subscriptions
Plans
- Moku Monthly: A$2.99 per month
- Moku Yearly: A$24.99 per year
Prices may vary by region and are displayed in your local currency at the point of purchase via the Apple App Store. Apple may charge additional taxes per its policies.
Auto-renewal
Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before the period ends. Renewal occurs through your Apple ID and is charged to your Apple-registered payment method.
Managing or cancelling your subscription
Manage or cancel your subscription at any time through your Apple ID: Settings → [Your Name] → Subscriptions → Moku → Cancel Subscription.
Cancelling before the next renewal stops future charges. Cancellation does not retroactively refund the current billing period.
Refunds
Refund requests for purchases made through the App Store are handled by Apple, not by Moku. You can request a refund at reportaproblem.apple.com. This does not limit your statutory rights under the Australian Consumer Law (see §14).
Price changes
We may change subscription prices. Where a price change applies to your existing subscription, Apple will notify you and may require your explicit consent before the change takes effect. If you do not consent, your subscription will end at the next renewal.
5. Acceptable use
You agree to use Moku only for its intended purpose — personal food and nutrition guidance.
You agree not to:
- Upload any image that is not a photo of food or a food product label
- Upload content that is unlawful, sexual, violent, hateful, harassing, or that depicts minors in any unsafe context
- Attempt to reverse-engineer, decompile, scrape, or extract the underlying AI prompts, models, or system architecture
- Use the App to develop a competing service
- Submit content that infringes any third party's intellectual property, privacy, or other rights
- Attempt to bypass our daily scan limits, paywall, or any other access control
- Use automated means (bots, scripts) to access the Service
- Resell, sublicense, or commercially exploit the Service
We reserve the right to suspend or terminate your access for breach of this section (see §11).
6. AI-generated content
Moku uses Google's Gemini AI model to analyse food images and return assessments such as "Go for it" / "Maybe not", glucose impact estimates, tags, explanations, and tips.
You acknowledge that:
- AI output is generated automatically and may be inaccurate, incomplete, or out-of-date
- The same food image may produce different results across scans
- Moku does not guarantee the accuracy, reliability, or fitness for any particular purpose of any AI-generated output
- AI output is informational only — it is not a substitute for professional advice (see §7)
Your food images are transmitted to Google's Gemini API for processing. See our Privacy Policy for details on data handling.
7. Health disclaimer — IMPORTANT
Moku is not a medical device, diagnostic tool, or healthcare service. It does not diagnose, treat, cure, or prevent any disease or medical condition.
The App provides general nutrition information based on visual analysis of food images. It is intended as a convenience tool for everyday decision-making and is not a substitute for:
- Advice from a qualified medical doctor, endocrinologist, dietitian, midwife, obstetrician, or other healthcare professional
- A personalised meal plan, diabetes management plan, or pregnancy nutrition plan
- Laboratory testing, allergen verification, or food safety certification
If you have diabetes or pre-diabetes
Glucose impact estimates are general guidance only. They are not a substitute for blood glucose monitoring, your healthcare team's advice, or insulin/medication decisions. Always consult your healthcare provider before making changes to your diet.
If you are pregnant or breastfeeding
Pregnancy mode references general food safety guidance (including FSANZ guidelines in Australia/New Zealand). It is not a substitute for advice from your midwife, obstetrician, or GP. Always confirm food safety decisions with your healthcare provider. When in doubt, do not eat the food.
If you have allergies or intolerances
Moku cannot reliably detect hidden allergens, cross-contamination, or trace ingredients from a photograph. If you have a serious allergy or intolerance, do not rely on Moku — verify ingredients with the manufacturer or food preparer directly.
In an emergency
If you are experiencing a medical emergency, call 000 (Australia) or your local emergency number immediately. Do not use the App for emergency decisions.
To the maximum extent permitted by law, Moku is not liable for any health outcome, allergic reaction, blood sugar event, pregnancy complication, or other harm resulting from your use of, or reliance on, the App.
8. Intellectual property
Our IP
The App, its design, branding (including the "Moku" name and logo), source code, AI prompts, content, and underlying technology are owned by Moku or its licensors and are protected by Australian and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes, subject to these Terms.
Your content
You retain ownership of the food images you upload ("Your Content").
By uploading Your Content, you grant Moku a non-exclusive, worldwide, royalty-free licence to process, transmit, and analyse Your Content for the purpose of providing the Service to you. This includes transmission to Google's Gemini API for AI analysis.
We do not use Your Content for advertising, model training, or any purpose other than providing the Service to you, except where required by law.

9. Third-party services
The App integrates with the following third parties, each with their own terms and privacy policies:

We are not responsible for the practices of third parties.
10. Beta features and changes to the Service
We may add, modify, or remove features at any time, including (without limitation) introducing new modes, changing daily scan limits, modifying paywall behaviour, or deprecating features.
Some features may be released as beta or experimental. Beta features are provided "as is" and may be unstable, incomplete, or removed without notice.
11. Termination
You may stop using the App at any time. To delete your account and associated data, see §3.
We may suspend or terminate your access if:
- You materially breach these Terms (including §5 acceptable use)
- We reasonably believe your use poses a security, legal, or operational risk
- We discontinue the Service
Where we terminate your access without cause and you have a paid subscription, we will refund the unused pro-rated portion of your current billing period via Apple where reasonably possible.
Sections that by their nature should survive termination (including §7 health disclaimer, §8 IP, §12 disclaimers, §13 limitation of liability, §14 ACL, §15 indemnity, §17 governing law) will survive.
12. Disclaimers
To the maximum extent permitted by law and subject to §14 below, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
We do not warrant that: - The Service will be uninterrupted, error-free, or secure - AI-generated output will be accurate, complete, or fit for any purpose - Defects will be corrected - The Service is free of viruses or harmful components
13. Limitation of liability
To the maximum extent permitted by law and subject to §14 below, in no event will Moku, its directors, employees, or contractors be liable to you for:
- Indirect, incidental, special, consequential, exemplary, or punitive damages
- Loss of profits, revenue, data, goodwill, or business opportunity
- Personal injury or health outcome arising from reliance on AI-generated output
- Any damages exceeding the greater of (a) the amount you paid Moku in the 12 months preceding the claim, or (b) AUD 100
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if Moku has been advised of the possibility of such damages.
14. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any right, guarantee, or remedy you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law where it would be unlawful to do so.
Our goods and services come with guarantees that cannot be excluded under the ACL. For major failures, you are entitled to a refund or replacement, and to compensation for reasonably foreseeable loss or damage. For non-major failures, you are entitled to have problems rectified within a reasonable time.
Where our liability cannot be excluded but can be limited, our liability is limited (at our option) to the resupply of the Service or the cost of resupply.
15. Indemnity
You agree to indemnify and hold harmless Moku from any claim, demand, loss, or expense (including reasonable legal fees) arising from:
- Your breach of these Terms
- Your violation of any law or third-party right
- Your misuse of the Service
- Your reliance on AI-generated output in a manner that causes harm to a third party
This indemnity does not apply to the extent the claim arises from Moku's negligence, fraud, or wilful misconduct.
16. Changes to these Terms
We may update these Terms from time to time. When we do:
- We will update the "Last updated" date at the top of this page
- For material changes, we will notify you in-app or by email (where we have one) at least 14 days before the change takes effect
- Continued use of the Service after the effective date constitutes acceptance of the updated Terms
If you do not agree to the updated Terms, stop using the Service and delete your account.
17. Governing law and dispute resolution
These Terms are governed by the laws of New South Wales, Australia.
You and Moku agree to submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or in connection with these Terms, subject to your statutory rights.
Informal resolution first
Before starting any formal proceeding, please contact us at support@trymoku.ai and we will attempt to resolve the issue informally within 30 days.
18. General
- Entire agreement: These Terms (together with the Privacy Policy and any Apple App Store terms) constitute the entire agreement between you and Moku.
- Severability: If any provision is held unenforceable, the remaining provisions remain in effect.
- No waiver: Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment: You may not assign these Terms. We may assign them to a successor in connection with a merger, acquisition, or sale of assets.
- No agency: No agency, partnership, or joint venture is created by these Terms.
- Apple-specific (required by Apple): You acknowledge that these Terms are between you and Moku, not Apple. Apple is not responsible for the App or its content. Apple is a third-party beneficiary of these Terms and may enforce them against you.
